Terms & Conditions
Last updated 1 August 2026
These terms set out what Fin-XTract does, what it deliberately does not do, and how a brokerage subscription works. They are written to be read once and understood, not skimmed.
01Who these terms are with
Fin-XTract is operated by MJC Broker Assist. In these terms, “Fin-XTract”, “we” and “us” mean that business, and “you” means the individual or business that holds a Fin-XTract account.
By creating an account, or by using the service under an account created for you by your brokerage, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
02What the service does
Fin-XTract reads financial statements and tax documents that you upload, extracts a defined set of line items under a published ruleset, applies add-back and subtraction logic across the current and prior financial year, and produces a results pack that records each figure alongside the page it was taken from.
Fin-XTract is a document analysis tool. It is not a credit assistance service under the National Consumer Credit Protection Act 2009 (Cth), it does not hold an Australian credit licence, and it does not make or suggest a recommendation about any credit product. Section 3 of our Disclaimer sets out where responsibility sits.
03Your account
You must provide accurate details, verify your email address, and keep your credentials confidential. Each person using the service must have their own login — shared logins defeat the per-user audit trail that a brokerage relies on and are not permitted.
Where a brokerage subscription covers several users, the account owner may invite, suspend and remove users, and can see usage attributed to each of them. The account owner is responsible for the conduct of users under that subscription.
04Documents you upload
You warrant that you are entitled to upload each document, and that you have the consent required under the Privacy Act 1988 (Cth) to have your client's information handled for the purpose of preparing a servicing assessment.
Uploaded documents are processed in memory for the duration of a run and are discarded when the results pack is produced. We do not retain a copy, and there is no facility to retrieve a document after a run — if you need it again, you upload it again.
05Acceptable use
You must not use the service to process documents you have no right to see, attempt to defeat quota or rate limits, reverse engineer the ruleset or the verification layer, resell access without a written agreement with us, or upload material that is unlawful or that contains malicious code.
We may suspend an account immediately where we reasonably believe continued use would breach this section, and will tell you why.
06Subscriptions, quota and billing
Plans are billed monthly in advance in Australian dollars through Stripe. Prices shown on the site are exclusive of GST, which is added where applicable. Card details are handled by Stripe and never reach a Fin-XTract server.
Extraction runs, re-runs and investigation work are unlimited. Only an exported results pack counts against the plan's monthly quota. Quota is enforced at the account level and resets on the renewal date shown in your billing settings.
07Changing or cancelling a plan
You may upgrade, downgrade or cancel at any time through the Stripe customer portal linked from your billing settings. A cancellation takes effect at the end of the current billing period, and you keep access until then.
We do not refund part-months. Where the Australian Consumer Law gives you a right to a remedy that cannot be excluded, nothing in these terms limits that right.
08Intellectual property
We own the service, the interface, the alias ruleset and the documentation. You own your documents and the results packs produced from them, and you may use those packs for any legitimate purpose in your business, including sending them to a lender or an aggregator.
If you give us feedback, we may use it to improve the service without owing you anything for it.
09Availability and support
We aim to keep the service available at all times but do not warrant uninterrupted operation. Planned maintenance is scheduled outside Australian Eastern business hours wherever practical.
Support is provided by email on every plan. Response targets differ by plan and are described on the pricing section of our site.
10Liability
To the extent permitted by law, our total liability arising out of or in connection with the service in any twelve-month period is limited to the fees you paid us in that period, and we are not liable for indirect or consequential loss, loss of profit, or loss arising from a credit decision made by you or by a lender.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
11Changes to these terms
We may update these terms as the service changes. Where a change materially reduces your rights we will give you at least 30 days' notice by email to the address on your account, and you may cancel before the change takes effect.
12Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State and the courts able to hear appeals from them.
